What is Mediation?

Mediation is an alternative way of solving disputes without the need to involve a court. It can facilitate an effective response to conflict and works best when participants are willing and able to look for a resolution. Situations it can be used in include:

  • Neighbourhood Disputes
  • Family Disputes
  • Employment Disputes
  • Debt Disputes

The underlying principals of mediation include:

  • Ownership
  • Empowerment
  • Impartiality
  • Confidentiality

The Mediator

The mediator's role is to stay impartial and not judge either party throughout the meeting. They are there to assist the parties to focus on the problem, and will explore the issues with the participants. The mediator will assist participants in outlining a realistic way forward. Gosport Borough Council has two fully qualified mediators who have undertaken extensive training. Any outcomes agreed by the participants are not legally binding.

Benefits

Taking a dispute through court is renowned for its expense and lengthy procedure. Mediation can allow for a quick less expensive solution than going to court. A mutually accepted agreement made between both parties is more likely to be complied with than one that is imposed by a third party, this is because the parties have come to an agreement they are both happy with.
